U.S. jury awards Apple $290 million in retrial against Samsung

SAN JOSE, California (Reuters) - A U.S. jury awarded Apple Inc about $290 million in a damages retrial against Samsung Electronics Co Ltd, restoring a large chunk of a historic verdict the iPhone maker won last year.

After a week long trial, the jury deliberated for nearly two days before reaching a decision on Thursday in a San Jose, California federal court. Apple had requested $379.8 million, while Samsung argued that it should have to pay $52.7 million.

Apple and Samsung have been fighting in the courts for over two years. Apple was awarded over $1 billion last year after it convinced a jury that Samsung copied various iPhone features - like using fingers to pinch and zoom on the screen - along with design touches like the phone's flat, black glass screen.

Earlier this year U.S. District Judge Lucy Koh upheld nearly $640 million of that verdict but ordered a retrial on the rest, ruling that the previous jury had made some errors in its calculations. Combined with the retrial verdict of $290.5 million on Thursday, Apple has now been awarded $929.8 million in the case.

Apple called its marketing chief Phil Schiller to testify during the trial. Samsung did not call any senior executives, a fact hammered on by Apple attorneys during closing argument. Juror Barry Goldman-Hall, 60, said the six-woman two-man jury discussed the disparity.

"We felt like we had way more information from Apple and we were left wondering why we hadn't gotten other information from Samsung," said Goldman-Hall, a therapist.

Samsung spokeswoman Lauren Restuccia said the company is disappointed by the verdict, especially because one of the patents in the case has been recently deemed invalid by the U.S. Patent and Trademark Office. Apple is contesting that finding.

Apple spokeswoman Kristin Huguet said it was grateful to the jury for imposing costs on Samsung, though she said the case has been more about protecting innovation than winning money.

Samsung manufactures phones that use the Android operating system, which is developed by Google. In addition to the fight over money, Apple is seeking a permanent injunction against several older Samsung phones. Koh had previously rejected such a sales ban, but earlier this week the U.S. Court of Appeals for the Federal Circuit ordered her to reconsider.

Nick Rodelli, a lawyer and adviser to institutional investors for CFRA Research in Maryland, said injunctions are much more important in these legal battles than monetary awards. Still, he said, the verdict shows that Apple's narrative was persuasive to a second jury drawn from Silicon Valley.

"A jury award on the high end of the range is a modestly positive signal for Apple," Rodelli said.

Colleen Allen, the jury forewoman, said Apple did not enjoy a home field advantage from having the trial so close to the iPhone maker's headquarters in Cupertino. Both companies are global players, she said, and while Apple engineers may be based in Northern California, its products are manufactured overseas.

The jurors based their decision on the evidence, said Allen, a 36-year old nurse.

"Samsung could've come up with a little more evidence," Allen said.

The case is likely to drag on as Samsung appeals both verdicts, said Brian Love, a professor at Santa Clara Law in Silicon Valley.

"Litigation between the parties is far from over, and there is no end in sight," Love said.

The case in U.S. District Court, Northern District of California is Apple Inc vs. Samsung Electronics Co Ltd, 11-1846.

BlackBerry 10.2.1 to receive improved Android Runtime

BlackBerry revealed some of the improvements that will come with the 10.2.1 version of the BlackBerry OS. The latest version of the OS will feature improved Android Runtime, thus allowing wider range of Android apps to run on the supported devices. BlackBerry announced that the 10.2.1 SDK for their mobile operating system will soon be available to developers and testers. A beta release of BlackBerry Tools for Android with new featured and several bug fixes will also be available.

Here is the changelog with some of the upcoming improvements:

Android Native Support: Android apps that use shared libraries written in native-code, such as C and C++, will now be supported on BlackBerry 10

Support is limited to the recommended system headers and APIs as documented by Google. Headers and APIs outside this scope may not function correctly.

Bluetooth: Android applications using Android Bluetooth APIs will now work on BlackBerry 10. Bluetooth Low Energy for Android is planned to be supported in a future OS release. As a reminder, Bluetooth LE is supported in the BlackBerry 10 Native/Cascades SDK.

MapView v1: Applications that use MapView from Google Maps v1 API are now supported using OpenStreetMaps. Support for MapView v2 API is being planned for a future release.

Share Framework: Android applications that register with the share framework in Android will now also appear as share targets on the BlackBerry 10 share menu.

Spellcheck: Applications that use text input can now leverage support for spell checking and correction, and the ability to add words to the BlackBerry 10 dictionary.

6.44 inch ZTE Nubia Z7 caught on film; device matches Sony Xperia Z Ultra's screen size

Depending on the survey you look at, Chinese handset manufacturer ZTE is either the 4th or 5th leading smartphone producer globally. But as executive vice president He Shiyou said on Monday, ZTE wants to move into the top tier of handset producers, a level currently inhabited by Apple and Samsung. To reach that goal, ZTE is no longer focusing on entry level models and is concentrating on highly spec'd devices like the ZTE Nubia Z5S it just introduced Tuesday morning.

The 6.44 inch screen on the ZTE Nubia Z7 matches the size of the panel on the Sony Xperia Z Ultra

The 6.44 inch screen on the ZTE Nubia Z7 matches the size of the panel on the Sony Xperia Z Ultra
Another model, not announced today but spotted in a photograph, is the rumored ZTE Nubia Z7. Looking at the photograph, the handset might seem massive in size, and that is because it is. The screen measures 6.44 inches and if that number sounds familiar, that is because it matches the 6.44 inch screen found on the Sony Xperia Z Ultra, which currently sports the largest sized smartphone screen in the industry.

The ZTE Nubia Z7 supposedly is powered by the more powerful MSM8974AB variant of the Qualcomm Snapdragon 800 CPU, which is clocked at 2.3GHz. The Adreno 330 GPU on board the phone is overclocked at 550MHz as opposed to the normal 450MHz. It is the same Snapdragon SoC found on the Samsung Galaxy Note 3 and the Xiaomi Mi-3. 128GB of native storage is packed on the device, which uses a custom ROM based on Android 4.4, KitKat.

It sounds like ZTE is hitting the ground running as it looks to close out 2013 with some strong momentum.

Oppo VP resigns, escalating rumors of a possible Oppo/CyanogenMod smartphone brand

Oppo VP resigns, escalating rumors of a possible Oppo/CyanogenMod smartphone brand
A rumor got jump-started during the weekend, claiming that Chinese Oppo may be planning a separate online smartphone company that will combine the premium manufacturer's build quality with the famed CyanogenMod custom ROM. According to cnBeta, Oppo's deputy general manager is interested in starting a new brand, though things didn't really blow up until it became known that Oppo's VP, Pete Lau, has resigned his post earlier today.

Obviously, it's entirely possible that we're all reading too much into it, especially considering how hard it is to make a dime off smartphone sales lately. On the other hand, companies like Xiaomi have managed to make it big by going for an online model, whereby they forgo the questionable benefits of brick & mortar locations in favor of online sales. This model has worked a miracle for Beijing-based Xiaomi, and perhaps Oppo is hoping for the same.

It's interesting to note that Lau has since commented on Chinese Weibo that they're working on something that "may change the world of Android", not to mention that there's apparently a "perfect Android flagship device" already in the works. That one is rumored to sport the upcoming 2.5GHz MSM8974AC version of Snapdragon 800 – the most powerful yet.

As we go forward, it'll be interesting to see just how the new brand will be structured and whether it'll be tethered to Oppo from the very beginning. Turning to the rumor mill once again, cnBeta reports that the new entity will be actually started from scratch and feature its own designs, hardware, brand and sales channels, though this remains unconfirmed (and a tad unlikely?). If anything it's quite unlikely that CyanogenMod will call it quits on Oppo quite so fast, seeing as the manufacturer has been pretty involved with the software company.

Super-thin Huawei Ascend P6 to become the Ascend P6S and sport an octa-core chipset

Super-thin Huawei Ascend P6 to become the Ascend P6S and sport an octa-core chipset
Chinese Huawei's flagship smartphone, the Ascend P6, has been snatching some headlines time these past three or four days, mostly thanks to the announcement that it'll get Android 4.4 KitKat by January's end. Perhaps intent on continuing the publicity streak, Huawei's president himself has taken to Weibo (Chinese Twitter equivalent) to share the company's plan to refresh its super-thin phone with a brand new octa-core chipset.

It's currently unknown whether we're talking the upcoming MediaTek MT6592 octa-core chipset or yet another one of Huawei's home-cooked boards. If history taught us anything, then we should hope for the former, as the 1.5GHz quad-core Hi-Silicon K3V2E processor in the current Ascend P6 is pretty underwhelming. Speaking of the MT6592, early benchmarks are actually pointing to a pretty decent all-round AnTuTu score of about 28,000 when pushing 1080x1920 resolutions. Of course, you do have to keep in mind that AnTuTu tends to get a bit generous with multi-threaded scoring, though we're likely talking about little to no-compromise performance nevertheless, even on a budget.

MediaTek is set to release the octa-core MT6592, along with a new quad-core (MT6582) chipset in two days time, on November 20. The line of upcoming octa-core devices from China already stretches over 10 separate OEMs, so do expect to be hearing a lot more about it throughout 2014.

Mike Adenuga, 2face Idibia, D’banj, Wizkid, Davido, others missing at Peter Okoye’s wedding

Peter Okoye and wife Lola Omotayo at their traditional wedding, November 2012
Peter Okoye's wedding to Lola Omotayo was the biggest event this weekend and will still have many talking about the glorious nuptials till the year runs out. But with the number of high profiled personalities and celebrities gracing the event, a few stars were noticeably missing from the social event.

Big names like 2face Idibia, D'banj, Wizkid Davido, Sound Sultan and 9ice did not attend the event.

While 2face was a few minutes drive away from the event (the Pop star had a billed music performance at the 'DSTV at 20′ anniversary event which held at Eko Hotels and Suites), D'banj was stuck in Johannesburg, South Africa (where he had performed at the Coke RockCorps show).

'Loved the show but now I'm stuck here as No flights out today and now I'm missing my brothers wedding @peterpsquare', D'banj lamented on his Twitter.

Wizkid and Davido had performed at a concert in Port Harcourt a day before. Waje

Also missing were fellow GLObacom ambassadors Waje, Wande Coal, Omawumi, Bez, Burna Boy were also missing. Other ambassadors like Naeto C, Lynxxx, Flavour, M.I not only attended but performed for the couple.

The father of the day Globacom boss Mike Adenuga also did not attend as expected but was represented by the COO of the telecoms company Mohamed Jameel.

Let’s Talk About It! Akon & Wizkid reportedly Refuse Dark Skinned Ladies from Video Shoot in Accra | Request for Half-caste

It seems with Akon and Wizkid, it's the lighter the better.
Akon & Wizkid - November 2013 - BellaNaija
The music superstars are under fire for allegations that the pair refused dark skinned girls from appearing in a music video in Ghana. They requested for half-cast ladies.

Fashion Ghana is reporting that some Ghanaian models were asked to participate by directors in an upcoming video shoot a few days ahead of the D-Day.

A  model allegedly claimed that on the day of the shoot some girls were asked to leave as the agent for the video shoot, stated that "they (Akon & Wizkid) now want half-caste girls".

The publication also reports that the dark skinned ladies turned away, were asked to seek light skinned girls because Wizkid and Akon were adamant on the request on late notice.

We often hear in Hollywood, how dark skinned African-American actresses like Viola Davis and Gabrielle Union loose roles to light skinned actresses like Halle Berry and Nicole Ari Parker.

Do you find their requests offensive? Are they wrong for choosing the type of women they want for their music videos?

Let's Talk about it!
